Beste leden,

Op donderdag 29 juni 2023 vindt vanaf 14.00 uur de voorjaarsbijeenkomst plaats, waarbij door mr. R.A.J. van Gestel en andere sprekers een lezing zal worden gegeven over het onderwerp “The Private life of public interest litigation: lessons from abroad”.

 

De voertaal van het inhoudelijke deel van deze bijeenkomst is het Engels. De doelstelling is om de deelnemers te informeren over algemeen belangrechtspraak in een rechtsvergelijkend perspectief, met daarbij veel aandacht voor andere rechtsordes. Er zal gesproken worden door Prof. Dr. Rob van Gestel en een aantal jonge onderzoekers die enkele resultaten van hun onderzoek presenteren.

De bijeenkomst zal worden gehouden op 29 juni 2023 van 14.00 uur in Grand Hotel Karel V, Geertbolwerk 1, 3511 XA Utrecht met aansluitend een borrel,

Voorafgaand aan de inhoudelijke bijeenkomst vindt de ledenvergadering plaats. Daarvoor staat op de agenda:

 

Opening van de vergadering door de voorzitter.

1.         Bericht over de bevindingen van de kascommissie over het jaar 2022.

2.         Goedkeuring jaarverslag 2022 en decharge van het bestuur voor het jaar 2022.

3.         Benoeming van mr M. Jongkind (advocaat bij Van Traa Advocaten N.V.) en mr. M.R. Lauxtermann (Lauxtermann Advocaten) over het jaar 2023.

4.         Sluiting.

De jaarrekening/financieel verslag over 2022 en routebeschrijving wordt hierbij gevoegd.

Prof. Dr. Rob van Gestel: The Private Life of Public Interest Litigation

Public interest litigation (PIL) seems to be on the rise in the Netherlands and with regard to certain topics, such as climate change litigation, also in the rest of Europe and even beyond. The Netherlands does not have a long history of cause lawyering, but that does not mean that it does not (also) raise questions here. The Urgenda climate case, for instance, led to a debate concerning the legitimacy of judicial lawmaking in these cases, which is by some experts seen as a violation of the separation of powers doctrine. Similar debates have been going on in countries, like the U.S., India and South Africa. I will try to shed some light on the common characteristics that PIL has across jurisdictions but also highlight some of the legitimacy issues that it has raised abroad in order to fuel the debate on what might be learned from experiences abroad.

Juliana de Augustinis: The Scientific Basis of Climate Change Litigation: Insights from a Structured Content Analysis

Since the first ruling in Urgenda Foundation v. State of the Netherlands in 2015, dozens of similar climate-oriented lawsuits spread across the globe. Besides claims of government failure to act against the ongoing climate crisis, these lawsuits share complex questions of law and science. To provide insights about the influence of scientific inputs in climate change litigation, Juliana is conducting a structured content analysis of courts' approaches to climate science in 43 judgments in 15 countries. In this presentation, she shares some preliminary findings of this analysis concerning whether the courts referred to empirical questions in their rulings, whether the judges assessed the scientific basis of factual assumptions and which arguments courts used, for instance, for not considering scientific evidence to support orders for more protective measures. A relevant outcome for discussion concerns how the decisions in Urgenda can be deemed bold in their use of IPCC standards and the application of the precautionary principle to order more ambitious GHG mitigations and advance climate protection if compared to many foreign decisions.

Anmol Gulecha: A Case study of the Suo motu COVID-19 Case before the Indian Supreme Court.

In 2021 the Indian Supreme Court initiated a suo motu public interest proceeding to review the Government's COVID-19 policies under the right to life of the Constitution. The Government's policies, which included medical counter-measures such as vaccination and lockdown, were allegedly inadequate in controlling the surge of COVID cases. To conduct its judicial review, the Court employed a bounded-deliberative method, the appointment of amicus curiae, and continuing mandamus. The Court emphasised that the right to equality and the right to life would guide the dialogue between the Court and the Government regarding COVID counter-measures. As a result of the suo motu action, the Government revised its COVID vaccination policy to ensure better universal vaccination coverage.

 

This presentation begins by describing the suo motu jurisdiction of the Indian Supreme Court, which is not commonly found in other jurisdictions. Following this, it explores how the Court utilised the above-mentioned methods to (a) review Government policies concerning COVID and (b) understand the macro-consequences of its decision(s).

Sharngan Aravindakshan: PIL in the US – The Role of the Special Master in Institutional Reform Litigation

In this presentation the role and function of the Special Master will be discussed, a judicial aide employed by judges to assist decision-making and implement remedies in complex cases of institutional reform. The discussion will be centered around one or two desegregation cases to illustrate this method of judicial decision-making.

Voor advocaten is nog van belang dat per 1 januari 2010 de Verordening op de Vakbekwaamheid van kracht. Deze Verordening geeft (Nederlandse) advocaten meer ruimte om opleidingspunten te behalen in het kader van de vakbekwaamheid. Kort gezegd mag de advocaat op de voet van art. 4 en 5 van de Regeling Vakbekwaamheid zelf beoordelen of een cursus zijn vakbekwaamheid ten goede komt en in aanmerking komt voor een puntentoekenning. Het bestuur zou zich kunnen voorstellen dat de door haar genoemde bijeenkomsten aan deze vakbekwaamheidseisen voldoen. Om aan te kunnen tonen dat u de bijeenkomst heeft gevolgd, vragen wij u binnen een half uur na afloop van de bijeenkomst een mail te sturen aan secretariaat@vasr.nl. In deze mail moet u bevestigen dat u het gehele inhoudelijke deel van de bijeenkomst heeft bijgewoond. Het is aan te bevelen dat u tevens het programma bewaart, waaruit de inhoud van de bijeenkomst blijkt. De Vereniging is zelf geen opleidingsinstituut en kan dus ook geen punten toekennen.
